1. Introduction

These Terms and Conditions (“Terms”) govern your use of the VirtualEye Rewards mobile application (“the App”) operated by VirtualEye Fun Lifestyle Rewards (Pty) Ltd (“VirtualEye”, “we”, “us”, or “our”), a company registered in the Republic of South Africa.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. Definitions

– “App” means the VirtualEye Rewards mobile application available on iOS and Android platforms.
“Account” means your registered user account within the App.
“Partner” means any third-party business, merchant, or service provider whose deals, offers, or rewards are featured on the App.
“Offer” means any deal, discount, promotion, voucher, or reward made available through the App by a Partner.
“Points” means the virtual loyalty currency earned and tracked within the App.
“User“, “you“, or “your” means any individual who creates an account and uses the App.

3. Eligibility

To use the App, you must:

Be at least 18 years of age
Be a resident of South Africa or a jurisdiction where the App is available
Provide accurate and complete registration information
Have a valid invite code during any closed registration periods

4. Account Registration and Security

4.1 Registration

You may create an account using your email address and a password, or by signing in with Apple or Google. You agree to provide accurate, current, and complete information during registration.

4.2 Invite Codes

Access to the App may require a valid invite code. Invite codes are non-transferable unless expressly permitted. VirtualEye reserves the right to revoke invite codes at any time.

4.3 Account Security

You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at az.oc.eyelautrivobfsctd-1c7233@troppus if you suspect unauthorised access to your account. VirtualEye is not liable for any loss resulting from unauthorised use of your account.

4.4 One Account Per User

Each user may maintain only one account. VirtualEye reserves the right to merge or remove duplicate accounts.

5. Use of the App

5.1 Permitted Use

The App is provided for your personal, non-commercial use to discover and redeem deals and rewards from our Partner network.

5.2 Prohibited Conduct

You agree not to:

Use the App for any unlawful purpose or in violation of any applicable law
Create false or misleading accounts or provide inaccurate information
Attempt to gain unauthorised access to the App, other user accounts, or our systems
Reverse engineer, decompile, or disassemble any part of the App
Use automated systems, bots, or scripts to interact with the App
Abuse the rewards or points system through fraudulent redemptions or manipulation
Resell, transfer, or commercially exploit offers or vouchers obtained through the App unless expressly permitted by the relevant Partner
Interfere with or disrupt the App’s functionality or infrastructure

5.3 Enforcement

VirtualEye reserves the right to suspend, deactivate, or permanently delete your account if you breach these Terms, without prior notice.

6. Partner Offers and Rewards

6.1 Third-Party Offers

Offers displayed in the App are provided by third-party Partners. VirtualEye acts as a platform connecting you with Partner offers and is not a party to any transaction between you and a Partner.

6.2 Offer Availability

Offers are subject to availability, validity periods, and the Partner’s own terms and conditions. VirtualEye does not guarantee the availability, accuracy, or quality of any Partner offer.

6.3 Redemption

Offer redemption is subject to the specific terms set by each Partner, including any restrictions on usage, validity dates, and minimum spend requirements. VirtualEye is not responsible for a Partner’s refusal to honour an offer.

6.4 Points and Rewards

Points earned through the App have no cash value and cannot be exchanged for currency. VirtualEye reserves the right to modify, adjust, or expire points balances with reasonable notice. Points are non-transferable between accounts unless otherwise specified.

7. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy, available at [https://virtualeye.co.za/privacy-policy](https://virtualeye.co.za/privacy-policy). By using the App, you consent to the collection and processing of your personal information as described in the Privacy Policy, in accordance with the Protection of Personal Information Act (POPIA).

8. Intellectual Property

8.1 Our Property

The App, including its design, features, content, logos, and underlying technology, is the property of VirtualEye Fun Lifestyle Rewards (Pty) Ltd and is protected by South African intellectual property laws.

8.2 Limited Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for its intended purpose in accordance with these Terms.

8.3 Partner Content

Content, logos, trademarks, and branding of Partners displayed within the App remain the property of their respective owners.

9. Disclaimers

9.1 “As Is” Basis

The App is provided on an “as is” and “as available” basis. While we strive to ensure the App functions correctly and offers are accurate, we make no warranties of any kind, express or implied, regarding the App’s reliability, availability, or fitness for a particular purpose.

9.2 Partner Liability

VirtualEye is not responsible for the products, services, or conduct of Partners. Any disputes arising from Partner offers must be resolved directly between you and the Partner.

9.3 Technical Issues

We do not guarantee uninterrupted or error-free operation of the App. We are not liable for any loss or damage resulting from technical issues, downtime, or data loss.

10. Limitation of Liability

To the maximum extent permitted by South African law:

VirtualEye’s total liability to you for any claims arising from your use of the App shall not exceed the total amount (if any) you have paid to VirtualEye in the 12 months preceding the claim.
VirtualEye shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

11. Account Termination and Deletion

11.1 Termination by You

11.2 Termination by Us

We may suspend or terminate your account at our discretion if you breach these Terms, engage in fraudulent activity, or for any other reason we deem necessary to protect the platform and its users.

11.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Any unredeemed points or offers will be forfeited unless otherwise required by law.

12. Changes to These Terms

We may update these Terms from time to time. When material changes are made, we will notify you through the App’s in-app consent mechanism. Continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree with any changes, you should stop using the App and delete your account.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
